Terms of Supply | Decathlon

Terms of Supply | Decathlon

Introduction

These are the terms and conditions of supply for http://www.decathlon.co.uk (Website) and Decathlon APP. Decathlon.co.uk and Decathlon APP are operated by Decathlon UK Limited trading as Decathlon (we, us and our). We are a limited company, registered in England and Wales. Our registered company number is 03140144, and our registered office is at 9 Maritime Street, London, SE16 7FU. Our VAT registration number is GB679262296.

You will find products and services offered on this Website (Products and Services) by Decathlon and also by professional vendors who are independent of Decathlon (Partners). You can find a dedicated page for each Partner on the Website.

Your purchase of any of the Products and/or Services on this Website is subject to these terms and conditions and by placing an order for any Product and/or Services you agree to be bound by them. You confirm that you are of full age or have received parental permission and that you have the legal capacity to enter into a contract and to subsequently place an order on Decathlon.co.uk for Products and/or Services. You should print a copy of these terms and conditions for future reference.

These terms and conditions also govern the contractual relationship between you and the Partners of Decathlon. There may be other specific terms and conditions of supply applicable to Products and/or Services sold on the Website by the Partners, in which case they can be found on a page dedicated to that Partner on the Website.

In addition to these terms and conditions, the following additional terms also apply to your use of Decathlon.co.uk and its associated features:

Decathlon and the Partners reserve the right to change these terms and conditions from time to time by changing them on Decathlon.co.uk, although no such change will affect any order you have already placed with us and/or our Partners. These terms and conditions were last updated on 3rd May 2023.

Ordering and availability

Products and/or Services may be ordered by clicking on the items you wish to purchase and then following the prompts that will appear on-screen. You may check and correct any input errors in your order up until the point at which you submit your order to us by clicking the "Pay Securely Now" button on the checkout page.

After placing an order, you will receive an email from us acknowledging that Decathlon and/or our Partners have received your order and giving you an order reference number. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us and/or our Partners to buy a Product and/or Service. All orders are subject to acceptance by us and/or our Partners. Neither Decathlon nor our Partners are obliged to accept your order and we and/or our Partners may, in complete discretion, decline to accept any order. You do, however, acknowledge that by clicking on the "Pay Securely Now" button, you enter into an obligation to pay for the Product(s) and/or Service(s) in the event that your order is accepted by us and/or our Partners. Where your order is accepted, we will confirm such acceptance to you by sending you an email that confirms this (Acceptance Confirmation). The contract between you and us and/or our Partners in relation to the Products and/or Services ordered (Contract) will only be formed when we send you the Acceptance Confirmation. After entering into the Contract, we and/or our Partners will be under a legal duty to supply you with Products and/or Services that are in conformity with the Contract. We will send you an email confirming when the Product has been dispatched together with (where applicable) a tracking number.

The Contract will relate only to those Products and/or Services we have confirmed in the Acceptance Confirmation. We and/or our Partners will not be obliged to supply any other Products and/or Services which may have been part of your order until the acceptance of such orders has been confirmed in a separate Acceptance Confirmation.

The Product and/or Service offers apply for as long as they remain visible on Decathlon.co.uk, except when special offers are available, in which case the term of validity of those offers will be stipulated on Decathlon.co.uk. You are advised to check the availability of items on the relevant Product and/or Service information page.

If an item ordered is not available, we and/or our Partners reserve the right to cancel the order, in which case you will be notified accordingly. If you place an order for several Products and/or Services, one of which is unavailable, we will inform you accordingly. The rest of the order will be processed and dispatched to you within the timeframe indicated on Decathlon.co.uk.

We and/or our Partners may also offer to replace the unavailable item with a similar item of similar quality with your prior agreement. In this case, if you then exercise your right to cancel the order after receipt of the substitute item, you will be required to pay the return postage costs.

You may access and review orders placed by you on Decathlon.co.uk by going to My Account.

Price and payment

The price of Products and/or Services is as quoted on Decathlon.co.uk from time to time.

Prices include VAT but exclude delivery costs, which will be automatically added (at the cost shown) to the total amount due once you have selected your chosen delivery method.

Prices and delivery costs are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Acceptance Confirmation.

Decathlon.co.uk contains a large number of Products and/or Services and it is always possible that, despite our and/or our Partners’ best efforts, some of the Products and/or Services listed on Decathlon.co.uk may be incorrectly priced. We and/or our Partners will normally verify prices as part of dispatch procedures so that, where a Product's and/or Service’s correct price is less than the stated price, we and/or our Partners will charge you the lower amount. If a Product’s and/or Service’s correct price is higher than the price stated on the Website, we and/or our Partners will normally, in complete discretion, either contact you for instructions before dispatching the Product or delivering the Service, or reject your order and notify you of such rejection.

Payment for all orders must be made by credit or debit card, via PayPal, by using Decathlon gift cards or loyalty vouchers, or any other means of payment available on the checkout page. We accept payment by most major credit and debit cards.

We will charge your credit or debit card to full payment as soon as we and/or our Partners pick the first item of your order in the warehouse. If we and/or our Partners unfortunately notice a lack of availability of one of the Products and/or Services, we will advise you immediately and you will be able to choose between the cancellation of the whole order or a partial refund.

Please note that in the payment transaction process, we ask the card issuer to ring fence (reserve) the amount of any order before we and/or our Partners pick the first item. It means that even if you order one item, it may still appear that you were charged for it, but as soon as we inform the card issuer that the order has been cancelled, the funds will be released straight back to you.

You should be aware that online payment transactions are subject to validation checks by your card issuer and we and/or our Partners are not responsible if your card issuer declines to authorise payment for any reason. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We and/or our Partners are not responsible for this.

Delivery or "Click and collect"

Your order will be fulfilled by the delivery date set out in the Acceptance Confirmation or, if no delivery date is specified and unless there are exceptional circumstances, then it will be fulfilled by Decathlon within 30 days after the date of the Acceptance Confirmation, and by the Partner within a timeframe as per the Partner’s specific terms and conditions of supply, which can be found on a page dedicated to that Partner on the Website.

Your order will be delivered to the delivery address within the United Kingdom (subject to the restrictions in the paragraph below) you specify when placing your order, unless you opt (where available) to collect it from your local Decathlon store or one of our and/or our Partners’ couriers from time to time, where the courier offers such a collection service. A list of the available collection points is available when selecting your chosen delivery method during checkout on Decathlon.co.uk. If you opt for this collection service, your entire order will be delivered to your chosen collection point and will be available for collection by you from the date specified in the Acceptance Confirmation or notified to you by us or the courier. When collecting your order, you should take with you the Acceptance Confirmation, along with some form of identification (such as a credit card or driving licence).

Orders cannot be delivered to Channel Islands, PO Boxes or similar addresses. Products and/or Services included within the same order cannot be delivered to different addresses.

We and/or our Partners offer a variety of couriers for deliveries of Products and/or Services, which you can select during the checkout process. It is not possible to specify a precise time at which a delivery will take place. Please note that the courier may require deliveries to be signed for.

Deliveries will be made to your door. Our and/or our Partners’ couriers will not be responsible for any additional carrying, unpacking or positioning of Products. If you order a large, heavy or bulky Products, you are advised to check that its dimensions (allowing for packaging) will allow it to pass freely through the doorways and corridors of the delivery address (or your car if you choose the Click and Collect delivery).

If you are unable to take delivery of items, you will have a certain period of time in which to collect the Product(s) from the specified courier. Thereafter, the Product(s) will be returned to us and/or our Partners and it will be considered that you have exercised your right to cancel your order.

Risk and ownership

Products ordered will be at your risk from the time of delivery or collection (as the case may be). Ownership of the Products ordered will also pass to you on delivery or collection (as the case may be), provided full payment of all sums due in respect of the Products, including any delivery charges, has been received.

Product information

Whilst we and/or our Partners have taken reasonable steps to depict Products as accurately as possible through the photographs and other images featured on Decathlon.co.uk, the detailing (such as colour, pattern and texture, etc.) you see on-screen will depend on your monitor and, as such, may not exactly reflect the actual detailing of a Product when you receive it.

- Under Part I of the Consumer Protection Act 1987; or
- For any other liability that may not, under English and Welsh law, be limited or excluded.

Losses are foreseeable where they could be contemplated by you and us and/or our Partners at the time your order is accepted by us and/or our Partners.
